Am I Eligible To Make A Broken Nose Compensation Claim?

Broken nose compensation can be claimed following a number of different accidents. While we can’t cover every possible scenario, you’ll see a few possible examples further down this page. Various third parties owe duties of care depending on the context. A duty of care means a legal obligation to keep someone safe.

We have set out the duties of care owed by different third parties here:

  • Employers are required to take reasonable steps to ensure the safety of their employees while at work. This duty is set down by the Health and Safety at Work etc. Act 1974
  • The parties in control of public places, referred to as occupiers, owe a duty of care imposed by the Occupiers’ Liability Act 1957. The law requires that occupiers take steps to ensure the reasonable safety of all visitors to their premises.
  • Every road user owes a duty of care to other road usersThe Road Traffic Act 1988 and the Highway Code impose standards that need to be met to discharge this duty of care.

The eligibility criteria for personal injury claims after you suffered a broken nose are summarised as follows:

  1. A third party owed you a duty of care at the time of the accident.
  2. The duty of care was breached in some way.
  3. This breach resulted in an accident in which you suffered injuries.

How Much Compensation Can I Claim?

Broken nose compensation can be awarded under two different heads of claim. These are:

  • General damages are awarded for the physical and psychological harm caused by the accident.
  • Special damages, which compensate for financial that result from your injuries. We’ll examine this in greater detail later in the section.

Those responsible for calculating a potential value for general damages can refer to your provided medical documents in conjunction with the Judicial College Guidelines (JCG). This publication contains guideline award brackets for a range of different injuries. We have used the facial injury brackets to create the below table.

Common Causes Of A Broken Nose That Lead To Claims

In this section, we look at how a broken nose injury could be sustained. We can’t cover every possible scenario here so to find out if you could claim in your particular circumstances, talk to our advisors today.

Possible examples of broken nose accidents are:

  • You were waiting at a red light when a speeding driver crashed into your vehicle. Your nose was broken when you hit the steering wheel.
  • A failure to undertake maintenance checks in a workshop resulted in faulty components in the pallet wrapping machine being missed. While you were loading goods for wrapping, the arm swung out and hit you in the face, breaking your nose and cheekbone.
  • The local council failed to respond to reports of a broken kerb on a road they were responsible for in a timely manner. You tripped on the kerb and broke your nose on the paving slabs.

Examples include:

  • Medical records.
  • CCTV or dashcam footage.
  • Workplace accident book.
  • Witness contact information.
  • Training and maintenance logs.

How Long You Have To Start A Broken Nose Compensation Claim

Most personal injury claims need to be made within 3 years of the accident occurring. This time limit was set down by the Limitation Act 1980. However, there are scenarios where exceptions to the general time limit can be made. These are:

  • Children: injured persons who were under 18 at the time of the accident will have the 3 years counted from their 18th birthday, giving them until they are 21 to start a claim.
  • Lacking sufficient mental capacity: persons who do not have the mental capacity to claim for themselves will have the time limit halted altogether. It only starts to run from the date they recover capacity.

In these scenarios, a suitable adult can be appointed or apply to be a litigation friend and make decisions about the claim for the injured person. This enables the claim to start much sooner. You can ask our advisors any questions you may have about the time limit in personal injury claims by calling the number below.

How Long It Takes To Get Nose Injury Compensation

There is no set timeframe on how long any personal injury claim takes. Each claim is assessed individually and influenced by a number of factors. These factors can include:

  • How severe your injuries are.
  • Whether or not the defendant admits liability straight away.
  • Acquiring evidence.
  • How complex the legal issues in the case are.

While we cannot provide an exact timeframe for any given claim, we can guarantee that our panel of solicitors will handle your case with the highest degree of professionalism and endeavour to get your compensation as fast as possible.
